POOL FENCE REGULATIONS - Does your pool pass the test?
Pool Safety Inspections, Pool Fence Inspections, Pool Safety Certificate, Pool Barrier, Pool Fence Regulations - What does it all mean?

Well effective pool fencing helps keep our kids safe.  This is why new pool fence regulations have been introduced in Queensland.

NEW POOL FENCE LAWS AFFECT ALL OWNERS OF EXISTING AND NEW POOLS AND SPAS

The pool safety register has been developed under the new pool fence regulations through the Pool Safety Council.  The register is being populated with local Gvernments' records of regulated pools across Queensland.   All pool owners have until 4 November 2011 to register their pool.  If your pool is not on the register after this date, penalties of up to $2,000 will apply.  Pool owners should check the register after 1 March 2011 to ensure their pool has been registered. Pool owners have until 30 November 2015 to comply with the new pool fence laws, OR earlier if they sell or lease their property before this time.  Both new and existing pools must have their pool fencing and pool barrier inspected and upgraded if necessary to comply with the new pool fence regulations by this date.

Even though pool owners have until 30 November 2015, a non compliant pool is still illegal and local councils can fine for non compliance.  Penalties of up to $16,500 and on the spot fines of $700 may be imposed for non compliant pool fences.  You will also be carrying liability insurance risks if a child drowns in a non complying pool. 

WHO DO THE NEW POOL FENCE REGULATIONS APPLY TO?
You must obtain a Pool Safety Certificate if you:

* are a property owner selling or privately renting out a house or a unit
* are a real estate agent selling or renting residential properties
* operate or own a hliday house, resort, motel, hostel, hotel or caravan park
* manage a Body Corporate or community title property

Landlords and Property Managers- Please note the below compliance phase-in dates:
Shared pool associated with short-term accomodation
      - 6 month phase-in
      - 31 May 2011
Shared pool associated with long-term accomodation
      - 2 year phase-in
      - 30 November 2012
Shared pool associated with mixed accomodation [long and short term]
      - 2 year phase-in
      - 30 November 2012
Non-shared pool associated with accomodation agreement
***Exemption***
      - 6 month exemption period from january 8 2011 - July 8 2011
      - Applies to non- shared pools associated with accomodation agreement ONLY
      - During the exemption period, homeowners are not required to have a pool safety certificate at the time the lease is entered into
      - If a pool safety inspector has been engaged, the 90 day reinspecton period still applies
      - Pool safety certificates will be required at the first new/renewed lease signed after 8 July.

Each inspection includes a detailed written report with photographs and recommendations should your pool not comply.  You inspector will talk you through the report and if requested, help you locate quality trade professionals to carry out the rectification work.

Advantage Pool Safety Inspections have a team of fully qualified Queensland Government licensed pool safety inspectors and provide pool fence inspections services throughout South East Queensland.  We will professionally assess whether your pool or spa fencing complies with the new pool fence regulations.  
If a pool fence complies with the new pool fence regulations we will issue a Pool Safety Certificate (Government fee of $30 applies). If it does not comply and the rectifications can be addressed within two days, we will re-inspect and issue a Pool Safety Certificate (Government fee of $30 applies).  If it does not comply, we will issue a nonconformity notice and produce a written report on what needs to be rectified.  We will also talk through the issues with you and if requested, help you locate quality trade professionals to carry out the rectification work. Owners with a noncompliant pool fence have up to 90 days to make changes, upgrades and repairs to bring it up to the required pool fence regulations.
