Pool Safety Certificates proposal for Real Estate Agents, Property Managers, On-Site Managers and Body Corporates

Don’t leave it too late...
New contract regulations in Queensland allow a buyer to terminate if a Pool Safety Certificate cannot be issued in time.  There are a large number of pools to be inspected and rectification works can take some time to arrange and implement.  Reinspection if required after rectification works have been carried out.

Advantage Pool Safety Inspections can provide a competitive pricing structure and as licensed Pool Safety Inspectors, we understand the complexities involved in providing accurate reports that comply with the new regulations as stipulated by the Queensland State Government in relation to new Pool Fence Regulations that must be completed before marketing a residential property for sale or rent.

Who needs to comply with the NEW regulations?
Owners of both new and existing pools are required to meet the new pool safety regulationsby 30th November 2015, or earlier if the property is sold or leased before this time.

From 1 December 2010, pool owners must have a valid Pool Safety Certificate—Form 23 from a licensed Pool Safety Inspector to sell or re-lease a property.

The law was introduced on the 1st of December 2010 and Real Estate Agents marketing residential property and their clients, must abide by the law or unfortunately suffer the severe penalties imposed by the act.

The new Pool Safety regulations are designed to ensure that all pools in Queensland have a current Pool Safety Certificate. Agents should encourage clients to take steps now to check on the status of any pool at the time, rather than wait until a buyer is found for the property.

The regulations introduce a new Pool Safety standard, which both new and existing pools must meet. This includes indoor and outdoor pools and spas associated with houses, townhouses, units, hotels, motels, caretaker residences, caravan parks, backpackers, hostels, mobile home parks and homestays (class 1 to 4 buildings).

The Real Estate Institute of Queensland and Queensland Law Society have updated several of their standard sale contracts to incorporate pool safety information.
